Binding Arbitration:If we cannot resolve the dispute informally, you and Affinity Partners agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or the use of the Site (collectively, "Disputes") will be resolved exclusively through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules.

Class Action Waiver: YOU AND AFFINITY PARTNERS AGREE THAT EACH PARTY MAY BRING DISPUTES AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.

Small Claims Exception:Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdiction (generally disputes involving less than $10,000).

Opt-Out: You may opt out of this arbitration agreement by sending written notice to info@affinitypartners.llc within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of the arbitration agreement.

14. Governing Law

These Terms and any dispute arising out of or related to these Terms or the Site shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Subject to the arbitration agreement above, you agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Dallas County, Texas.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

16. Entire Agreement
